Scope and Exceptions

1 Scope

This customer information and terms and conditions apply to all sales contracts between us, Hollandvelo, and you, ie customers in Switzerland and the Principality of Liechtenstein, insofar as such contracts are concluded over the Internet. They are not applicable to agreements between Hollandvelo and its business partners. We only recognize deviating regulations if they are confirmed by us in writing. We are entitled to supplement, change or delete these GTC at any time. The current and binding version of the General Terms and Conditions are published at www.hollandvelo.ch and are deemed to have been accepted by you if you do not object within 30 days.

2. Contracting Party

3. Registration

3.1 When entering your personal data required for registration, you are responsible for truthful and complete information. You are obliged to treat your personal access data confidentially and not to make it accessible to unauthorized third parties.

3.2 You are solely responsible for content that you post in areas accessible for this purpose. These must not infringe the rights of third parties. There is no right to storage or publication of your content, such as product reviews.

3.3 Each customer is only entitled to maintain one customer account at a time. We reserve the right to delete multiple registrations and to warn or terminate members who violate the provisions mentioned in Sections 3.1 to 3.3 or to delete or change content (virtual domiciliary rights).

4. Conclusion of contract

4.1 Hollandvelo’s online offer can be seen on the website www.hollandvelo.ch and is non-binding. We reserve the right to make price and product range changes as well as technical changes at any time. All offers are non-binding and not to be understood as a binding offer. All information on www.hollandvelo.ch (product descriptions, illustrations, films, dimensions, weights, technical specifications, accessory relationships and other information) are only to be understood as approximate values ​​and in particular do not represent any guarantee of properties.

4.2 Your orders on the website are – subject to the following paragraph – binding offers for the conclusion of corresponding sales contracts with Hollandvelo. We reserve the right to reject such offers within 7 working days of receipt by sending you a corresponding declaration by email or letter.

4.3 We make every effort to align the scope and execution of the delivery with the wishes you specified in the order. However, only the conditions that apply to us in the order confirmation (product properties, price, shipping and ancillary costs) are binding. The order confirmation sent automatically by the web shop system by e-mail does not count as an order confirmation. Unless otherwise stated in the order confirmation, shipping costs are at the expense of the customer.

4.4 By concluding the contract, you expressly declare your consent to the processing of your personal data in accordance with Hollandvelo’s data protection regulations, which are available on this website. A contract cannot be concluded without this consent.

5. Price and Availability

Despite the utmost care, erroneously incorrect information cannot be completely ruled out. All price information is non-binding. Prices at the relevant outlets are valid. Offers may only be available in limited numbers. Due to high demand, products can sell out quickly. Hollandvelo cannot be held responsible for unavailable products or incorrect pricing by mistake. We reserve the right to make model changes. Timed offers are only valid for the specified period of time. All prices are net including VAT in Swiss francs (CHF).

6. General terms of delivery and payment

6.1 Hollandvelo accepts the following methods of payment: bank or postal transfer , TWINT , PayPal , invoice , PostFinance e-finance , PostFinance Card , credit card/debit card . In the case of invoicing (advance payment), the due date is usually 10 days. In the case of purchase via a PayPal account, your credit card account will be debited upon completion of the order. With every order, we reserve the right not to offer certain payment methods and to refer to our other payment methods. Hollandvelo’s claim for payment cannot be offset.

6.2 Please note that we can only accept payments from accounts within the European Union (EU), Lichtenstein and Switzerland. Any transaction costs are at the expense of the customer.

6.3 The delivery of the ordered goods takes place after receipt of payment by the delivery service commissioned by us in accordance with the conditions stated in the delivery confirmation. The delivery date is given to the best of our knowledge, but without guarantee. Large/bulky products are delivered to the destination address by Hollandvelo or the carrier after consultation with the customer. Public access for trucks is required. In the event of delays in delivery, the customer will be informed immediately by Hollandvelo. In the event of definitive unavailability of the items ordered, the payments made will be refunded. Hollandvelo is not liable for delays in delivery caused by manufacturers or third parties. If not all ordered products are in stock,

6.4 The burden and risk of the goods pass to you when they are handed over to the delivery address.

6.5 If the handover to you cannot take place for reasons for which you are responsible (e.g. incorrect or incomplete addressing, refusal to accept delivery without justifiable reason, etc.), you will be charged for the resulting costs (e.g. new delivery, return shipment, etc.) in invoiced.

6.6 If goods are delivered with obvious damage to the packaging or the contents, you must complain to the carrier/parcel service provider immediately and refuse acceptance. Hidden defects must be reported to the forwarding agent/parcel service provider (e.g. responsible post office) within 24 hours (1 working day) after receipt of the goods. The customer is obliged to have a damage confirmation message from the parcel deliverer (e.g. postal employee) handed over to him. All transport damage must also be reported to Hollandvelo immediately.

7. Shipping & Shipping Costs

The bicycles are delivered 100% roadworthy by one of our transport partners. We will contact you before delivery to schedule an appointment when a delivery is possible for you.

The bicycles are prepared by us and delivered ready to ride by a forwarding agent to the desired address within Switzerland and Liechtenstein. The customer has to make slight adjustments such as adjusting the handlebar position, the height of the saddle and attaching the pedals himself. Instructions can also be found in the supplied manual. The delivery costs are a flat rate of CHF 40 per delivery.

Unless otherwise noted, all other orders such as accessories and bicycle accessories are delivered by post at a flat rate of CHF 7.40. From an order value of CHF 99, delivery is free of charge for you.

8. Right of Withdrawal

8.1 You can cancel your order within 14 days of receipt of the goods and thus withdraw from the contract. If you exercise this right in a timely manner, you are no longer bound to your order.

The revocation can be made in writing by registered letter to the address given under Section 2 of the General Terms and Conditions or by returning the goods to the following address: Hollandvelo Tholen, In der Ey 29, 8047 Zurich. Deadline is sufficient for the timely dispatch.

8.2 The right of return does not apply to the purchase of gift vouchers.

8.3 In the event of a cancellation, you are obliged to return the goods to us at your own expense and risk.

8.4 All items returned in this way will be checked by us. Purchased products must be returned in their original packaging and must not show any signs of use.

A return will be rejected if:

  • traces of use are visible,
  • the product is not returned in its original packaging,
  • the product is damaged due to the return transport,
  • or the product has already been redeemed in some form (incl. day admission).

8.5 As far as possible, the repayment will be made using the means of payment you used when making the purchase or by arrangement.

9. Retention of Title

The delivered goods remain our property until the purchase price and the associated costs have been paid in full. We are entitled to make a corresponding entry in the retention of title register.

10. Hollandvelo Limited Warranty

Hollandvelo provides the following limited warranty on the products you have purchased:

10.1 You must check the purchased product within 14 days and, if it is defective, notify Hollandvelo immediately. Otherwise, the object of purchase is deemed approved. After that, only hidden defects can be asserted. If you have any further questions about how to proceed with warranty claims or returns, you are welcome to contact our head office (+41 43 539 24 12) at any time.

10.2 Unless otherwise stated on the product or on the invoice, Hollandvelo warrants that the purchased item is free of defects and functional for a period of two years from the conclusion of the purchase or collection or home delivery. Hollandvelo can provide the warranty service either by repairing it free of charge, replacing it with an equivalent value or by refunding the price of the product. Further claims are excluded.

10.3 Hollandvelo grants a 5-year manufacturer’s guarantee for damage to the paintwork and frame breakage.

10.4 Normal wear and tear and the consequences of improper handling or damage by customers or third parties, as well as defects attributable to external circumstances, are not covered by the Hollandvelo guarantee. The guarantee obligation expires in the case of repairs carried out by service points not authorized by Hollandvelo. If the warranty certificate or proof of purchase (receipt, invoice) is missing, any warranty claim becomes void.

We value customer satisfaction. You can contact us at any time using one of the contact methods specified above. We endeavor to examine your request as quickly as possible and will contact you immediately after receipt of the documents or your input or complaint.

11. Liability

Claims of the customer other than those expressly granted in these General Terms and Conditions are excluded, regardless of the legal basis and to the extent permitted by law. This exclusion of liability also applies in particular to the actions of Hollandvelo’s contractual partners, auxiliary persons, etc. and to all consequential damages, lost profits or other financial losses of the customer.

12. Assignment Prohibition

You may only assign your contractual rights to third parties with our written consent.
